Is it just a lack of proof ? The doctor’s testimony and report seemed to be damming enough.

The CCTV footage seemed to be fairly significant in terms of the DPP not pursuing it.

Lying to her partner is problematic on terms of credibility even though I understand why she did it.

Apparently she contacted him as she wanted to continue partying, she is saying that she took cocaine that he provided so I am guessing with drugs involved testimony regarding the events in the night could be deemed as inadmissible due to state of mind.
Also, text messages between both were flirtatious before the event.

Again, none of the above proves he didn’t do it but the DPP were probably not going to risk a high profile case where reasonable doubt would mean a chance of an innocent verdict.

I presume the DPP have some sort of metric they use when it comes to deciding on whether to take a case or not.

Seems to have got worse again this morning

They are showing CCTV footage in the corridor of her kissing the other fella she claims to have also raped her, and her response was that whilst it looks like she was engaging wilfully that it is out of character for her, and she cant remember any of it. She even had the hotel she was in wrong in her statement to gardaí - she thought she was in Temple Bar and she was actually all of the way out in Sandyford

What happened in the bedroom wont be on CCTV but there are medical records etc to show that she had a rough time of it. I think the jury will have a big problem believing that she is reliable or has any idea herself what happened in hindsight as she was off her game on coke and drink, but maybe thats the point and they will decide that McGregor and his buddy took advantage of her when she clearly was not in full control of herself and able to consent?

If she is incapable of consent then it's rape. I'm hopeful that that, and the medical evidence, will get her over the line in a civil trial..
