yep - which presumably is what the DPP advised her

the defence read the DPP's assessment of the case to the jury today which will linger also even if the judge directed that they shouldn't be guided by it
 
Rape trials often are very traumatic and you would think from reporting at times that it was the alleged victim who is on trial not the alleged perpetrator.
Responsibility and fault etcetera seem to be what is being discussed here in this case.

"The only person with ultimate control over whether the rape took place is the rapist".

That's my take on any rape case and it's up to the jury here to decide who had ultimate control.

Of course and you are spon on.Only thing jury will ponder is why phone your rapist next morn at 6 for a chat.

I'm sure they have to ponder and deliberate over every aspect of case in question. State of mind and consent being key.
Never been on a jury yet ,but I take it that Judges give direction to juries after summation of both defense and prosecution cases.
 
People do all sorts of odd things when they are traumatized.

How many cases have we had of murder suicide in this country where the families first reaction is to bury the couple together, for example?
Alan Hawe was buried with the family he butchered in Co Cavan but later exhumed and cremated.

My question is what is the definition of incapable of consent?

Is it unconscious, or does being drunk count, if so how drunk?

How can someone prove how drunk they were, in fact its probably the opposite in that we always think we are more sober than we actually were?

There isn't an objective test so it will be a matter for evidence.

Or if both parties are off there head on drugs.
 
civil case is perfect for this. People might be angry at the DPP but that’s a much higher bar. There’d have been extensive damage done if Conor McGregor was up for rape in Dublin Circuit Court and gatched out of court after being acquitted.
