Circumstantial evidence is a big factor in the French system.
 
Are there many miscarriages of justice there I wonder, sometimes here everyone knows someone is guilty but the evidence isn't strong enough to pin it on them.

I guess it happens but Bailey is a point in case to the differing systems. In any event if he was extradited he would have to stand trial there as the first judgement was in abscentia.

Ireland May be too lenient in many aspects of the law but banging someone up on circumstantial evidence is not right either.

Algerian-born Irish citizen Damache sentenced to 15 years in prison​



High Court judge Ms Justice Aileen Donnelly delivered her judgment refusing the State's application for the extradition of Ali Charaf Damache at the request of the United States.


No problem for the Spanish to send him on his merry way. On a side note, they tried to strip him of his Irish Citizenship, but the Supreme court stopped it. The law still has not been amended, so he will be coming back here when he has finished his sentence.

Why didn't they send him to the States?
They know how to deal with his sort.
