A non binding (but highly presuasive) opinion has been issued by the Advocate General that the retention and access to phone data was unlawful and that the ruling should be retrospective. The Court may or may not take this opinion.
If they take the opinion then it still has to go back to the Irish SC. It may then go to the Court of appeal.
It is a good ruling from his pov, but he is far from having won his case.
