VICTIMS of notorious paedophile Bill Kenneally are "furious" after sensitive data relating to a public inquiry probing if their abuser was protected by a cover-up vanished on a missing USB key.

It emerged this week that the Department of Justice and Equality lost evidence from the Hickson Commission when the device went missing while being transported between Government buildings.

The memory stick has not been found.

The Department insists that the device was encrypted, but the decision not to tell victims about the blunder has sparked outrage.

Abuse survivor Colin Power, Waterford, has campaigned tirelessly to lift the lid on the secrecy surrounding Kenneally's crimes and describes this latest revelation as "devastating."

Basketball coach Kenneally (70) was jailed in 2016 for 14 years for the horrific abuse of teenage boys in the 1980s in Waterford.

The Hickson Commission was set up in 2018 by the then Justice Minister Charlie Flanagan on foot of claims that members of Fianna Fail, the Gardai, the HSE and the Catholic Church were all told of the abuse but swept it under the carpet.

Mr Power told the Sunday World: "How do we know it was encrypted, are we supposed to just take their word on it?

"We don't know that that USB key didn't have things like counselling notes on it.

"What other information are they keeping from us?"


He added that this latest fiasco comes off the back of months of an agonising wait for the inquiry to progress.

"For me personally this Commission, which started in 2018, has been a battle from day one.

"It's been delay after delay and the victims certainly aren't treated with the respect they deserve."

Official documents state that the memory stick vanished on the short journey between the two Department of Justice and Equality buildings on Hanover Street and Tom Johnson House in Dublin at an unspecified date in 2019.

The outcome of the incident is that "in case of heightened impact on Data Subject, material will be hand delivered in future".

But this is little comfort to the victims.

Their lawyer, Darragh Mackin, told the Sunday World: "We are extremely concerned that data relating to the Commission has been lost and no effort has been made to reassure my clients that sensitive information in relation to their own cases has gone missing.

"We will be seeking urgent clarification on the matter from the Department of Justice.

"Naturally, this is alarming for all of the victims who now fear that private information in relation to their cases was stored on that USB key.

"It is not enough to suggest that because the USB key was encrypted that no further action is required.

"Transparency and a victim-centred approach is essential and is what we were promised.

"This is extremely disappointing."

The Department of Justice and Equality told the Sunday World the USB stick had been encrypted.

"In May 2019, having been made aware of the loss of the USB stick containing personal data in relation to the Hickson Commission, the Department of Justice, as required by the GDPR and the Data Protection Act 2018, notified the Data Protection Commission (DPC). The Data Protection Officer investigated the circumstances surrounding the missing USB stick and the outcome of that investigation was subsequently notified to the DPC.

"The investigation found that;, despite a thorough search of both premises the missing USB stick was not located. "An Post indicated that no USB stick was identified in their Recovery/Reclaim Unit.

"The data contained on the USB stick had previously been uploaded to the Commission’s secure system prior to being mislaid.

"As the data contained on the USB stick continued to be available to the Commission and the missing USB stick was encrypted to industry standard the risk to individuals whose personal data was on the USB stick was evaluated (as required by legislation) and found to be low as, any third party finding the USB stick would be unable to access any information contained. "

This was a guy that preyed upon multiple victims for decades. And they managed to lose a memory stick containing evidence between two Government buildings which is the latest in delays for the victims. And then they took the decision not to tell the victims what had happened

Those in power can do what they like and get away with it...north and south
 
Let's hope that the Government Departments put in charge of the information from the Enquiry into abuse at Mother and Baby Homes take better care of the information of those involved
