Rebecca's Counsel, Bruce Antoniotti SC today told the High Court the young woman who became a mother just two weeks ago accepted the accident was her fault and she acknowledged she should not have been tram surfing and she knew at the time it was a dangerous activity.

she was on the "non platform side of the train" jesus christ, that means the track side, thats so, so dangerous, it's a wonder she's still alive.

How in the name of God is anyone but herself liable?

And she has brain injuries, but had a child last week. That surely won't be good for the child's health?
 
She did the scutting. She fell off. All her own doing. why the fuck should she get money. The driver should sue her for stress. we'll all end up paying for her stupid behavior

It doesn’t really Ponti - it explains that it was a settlement rather than an award, and therefore we have to assume that based on professional advice taken Viola were not confident of winning the case in our courts which is hard to believe

All that says to me is that personal responsibility has no part to play any more unfortunately, and outlandish cases like this are absolutely possible to win and screw us all out of money ultimately

The company were afraid to go to court incase of a higher award being given and that was down to what they thought was their lack of personal responsibility. I suppose we can look at in many ways.

Of course she shouldn't have been on the roof of the tram itself, but it's up to the company to try and ensure this couldn't happen after being warned of many previous episodes. They put nothing in place to try and prevent it occuring again. She was just a silly 13 year old after all.

Ah it does.

The company have a responsibility to take action if they are aware of a dangerous activity, esp when it involves children. Read up on Crowley-v- AIB for more on that.

The company took remedial action, but not before this accident happened.

Her age is also a factor. There is a lower expectation of common sense from a 13 year old than for an adult.

So if they did not take remedial action would the outcome to this case have been any different?
