A developer held a saw to a 13-year-old boy’s neck while he pinned him down on a table, threatened to kill him and choked the boy until he passed out.
When the boy came to about 10 seconds later, 40-year-old Cathal O’Connor was still punching him, according to evidence heard at O’Connor’s sentence hearing at Sligo Circuit Criminal Court on Friday.
O’Connor, of Farmleigh Manor, Sligo, pleaded guilty on Tuesday to three counts of assault causing harm to three youths at the Northwest Business Park, Collooney, Sligo on March 18th, 2024. Six other charges of threats to kill and false imprisonment were taken into consideration. All three boys were 13 years of age when assaulted.
His co-accused, father-of-five Simon Cavanagh (39) of Brú na hAbhainn, Collooney, Co Sligo, pleaded guilty to three counts of false imprisonment.

Cavanagh left and then arrived back with a third boy, and O’Connor punched this boy with such force he fell to the ground and banged his head. His nose and mouth were bleeding. The boy was “bawling crying” and “in complete shock”. O’Connor also struck him with a metal bar.
The boys suffered black eyes and scratches and bruises to their face, neck and chest. A 13-year-old girl with the boys was unharmed but upset. The boys were then told to go and O’Connor warned them not to tell the gardaí.

Shortly before the incident, Mr McCaughley ordered fish and chips from a takeaway where staff said he was “in good form”, Detective Sergeant David Ennis told Diana Stuart SC, prosecuting, during an earlier sentence hearing.
Another witness waiting for a bus told gardaí that he saw three youths passing an older man as he walked along Fairview Strand. He said he saw one of the young men – Rush – employ a “back spin kick, like MMA” on the older man, causing him to fall on his back.
A post-mortem exam carried out by assistant state pathologist Dr Margot Bolster found the cause of death was traumatic brain injury due to a significant fall to the back of the head.
The judge said Rush had given a “self-serving” account of what occurred, including that the victim spat at him but noted that he and the two other men crossed the road to where Mr McCaughley was walking. She also referenced a witness account that the victim was wearing a face mask at the time.

She said the court “didn't take kindly” to the defence assertion that the victim may have had drink taken. “Whether he had or hadn't, he was going home with a bag of chips,” the judge said.

I suppose it depends on whether the fella you killed by roundhouse kicking him into the head is mid-range dead, or seriously dead
 
Waterford’s answer to Frank Buttimer asks the judge to reconsider giving prison time to his client with 147 previous theft convictions, because she’ll lose her council house if she gets sent inside. God love her.

The court was told she had 147 previous convictions, mostly for theft and an outstanding suspended sentence.

Judge Cheatle activated the nine-month suspended sentence.
He also sentenced Ms Flynn to 10 months in prison, for the sale and supply charge, to run consecutively.

But he suspended that sentence for 24 months and took all other charges into consideration.

He fixed recognisance at €200.
 
I immediately thought Nolan. I don't know if I'm alone here but i intuitively expect women judges to be especially harsh on crimes against girls and women so when a lenient sentence comes from a female judge it feels more jarring than when it comes from a male judge.


Wicklow man who sexually assaulted six-year-old girl given fully suspended sentence​

A WICKLOW MAN convicted of sexually assaulting a six-year-old girl has been handed a suspended sentence.

Ethan Lacey (26) of Saint Brigid’s Terrace, Lower Dargle Road, Bray, Co Wicklow, was found unanimously guilty by a jury of one count of sexual assault of a child on 1 August 2022 at a Dublin address.

The jury heard that Lacey placed his hands on the then six-year-old’s legs and was seen “cupping” her genital area with his hands, all while trying to distract the child with sweets. The young girl was clothed at the time.

Judge Sinéad Ní Chúlacháin outlined that the aggravating factors in this case were the child’s age at the time and the age gap between Lacey and the child.

The judge also noted that the child did not suffer any immediate physical injuries but has been referred for counselling and that her “innocence was taken away at the age of six.”

The judge said there was no evidence of premeditation or planning on Lacey’s part, and no breach of trust, as the child did not know Lacey. She set a headline sentence of three years for the offence.

Judge Ní Chúlacháin said she must have regard to the mitigating factors in this case, such as Lacey’s own childhood, as set out in the report submitted by the defence.





She also noted that Lacey has the support of his family, is in part-time employment, has no addiction issues or any previous convictions.

Judge Ní Chúlacháin imposed a two-and-a-half-year sentence, which she suspended in full for three years. She further placed Lacey under the supervision of the Probation services for three years and instructed that he must carry out all directions deemed necessary by them.

At a previous hearing, the court heard the now nine-year-old is being assessed for play therapy, and while not fully aware of what happened, she is showing signs of anxiety.

Marc Murphy BL, defending, said his client does not deny there was contact, but maintains it was not sexually motivated.

Murphy asked the court to consider the contents of a psychological report, which states his client denies any sexual attraction to children and is assessed at low risk of re-offending.

He said that while the court may consider the offending “brazen” as it took place with others present, he suggested that this could give weight to his client’s position that there was no sexual motive.

He said his client has experienced tragedy in his life, including the death of a sibling. His client is in a relationship, and his partner and parents were in court to support him.

Murphy noted his client has no previous convictions, no history of violence and a good work history. He submitted that there is a “striking absence of red flags” which the court may see in other similar cases.

He asked the court not to impose an immediate custodial sentence.
