I do concede that I've heard numerous similar stories about these solicitors, including lying in court about receiving correspondence that they both answered and raised in a responding affidavit 🙈
Are you sure it isn't the other partner that is instructing where the summons is served?

I am always sceptical about the stories of Solicitors lying in those situations etc. If caught they will be disbarred. Why would they take the risk of that for any one client?

Be very careful about associating lying in court with anyone before the bench.

They had to issue an apology in open court.
They received a letter on X date regarding change in financial circumstances, having postponed several court dates. The letter stated they could no longer sustain the financial situation and having made several attempts to bring the matter to court, now had to make a change.

They got a reply that there was a court order etc.

They then issued proceedings for non payment 5 months later. In their affidavit they referred to the letter of X date.

In court they claimed there was no correspondence from solicitors and payment was just stopped. When questioned on they said they never received the letter.

Did the person refer it to the LRSA?

If not, they should.

I'd be surprised the Judge didn't tbh.
