An Bord PleanĂĄla has cleared the way for Harry Crosbieâs planned Vicar Street hotel scheme for Dublin 8 after invalidating the only appeal against the hotel proposal on technical grounds.
The appeals board invalidated the appeal after appellant and newly elected Sinn FĂ©in TD for Dublin South-Central, MĂĄire Devine, enclosed the incorrect Dublin City Council procedural letter with the appeal.
Instead of enclosing the councilâs acknowledgement of her objection, Ms Devineâs appeal enclosed the council letter confirming that planning permission had been granted. âIt was a stupid thing, a silly mistake to make but it is very petty to invalidate an appeal for such a reason. The rules need to be revised,â Ms Devine said.
The TD said she was devastated that her appeal was invalidated. âIt is one battle lost, but not the war,â she said. âThis wonderful community of the Liberties will stand firm â their vision for their community must be respected and supported. âThe very essence of what makes the Liberties a place apart must be recognised and treasured.â
Mr Crosbie has insisted the area needs another hotel. âIf you walk up Thomas Street on a night when Vicar Street is closed, it is like a derelict street,â he said. âIt is threatening and dark and unwelcome.
What the area needs more than anything is people moving around the streets.â Mr Crosbie said that the objectors to the hotel scheme âkeep talking back about the rare auld timesâ. âThey are gone. What we are doing is bringing life back to the city. That is what I am hoping to do.â

As in she didn't actually lodge the fucking appeal?

If Fierce was grandstanding in the Dail he'd be calling it 'gross incompetence' and looking for heads to roll, with a suitably stern visage surrounded by a cabal of the equally outraged

The classic one is people think you've a month to appeal. So if the decision was on the the 28th they lodge the appeal on the 28th. They then find you have a month means cob of the 27th.The requirements are clear, almost everyone that uses the planning system will have fallen foul of a small mistake costing you a valid application/appeal or whatever. Itâs a pain in the hoop as there is absolutely no flexibility, but these things have to stand up to a judicial review in court if it runs the full course and no judge will accept lodging the incorrect documents or missing a date.
