Again I'll ask, how does the guard prove, beyond a reasonable doubt, that the lady in question IS capable of understanding and speaking English?

For example, if I wanted to play dumb it would be very difficult for anyone to prove categorically that I can speak and understand Irish.




I just thought it worth mentioning as I think it germane to the discussion being had with regard to that defendant who's been here 20 years yet needs an interpreter. You seem to be annoyed that I brought it up.

Do you not understand what direct testimony is? He is not required to prove it, but he can give evidence to the Judge of his experience of the defendant.
