Free legal aid, the biggest scandal in Ireland ?

a solicitor friend of mine at a wedding in Kerry last year received a phone call from the gaurds saying one of his free legal aid clients needed him at a station, this was just as we were sitting down for the meal. He left and drove back to Cork to meet this repeat offender and on returning late that night he said to me that he had to go because the prisoner in question was, and I quote "worth too much to him"

That says it all about the legal business I keep on about on this site.

What does it say? That a professional looks after a client that they will earn money from. That is a fundamental in pretty much every business.

As for your second point, hard to answer. I don't have family in this business and I have never had a problem getting a job. There are quite a few family firms in the city alright, but if you are a Solicitor and you have a son/daughter who has become a Solicitor it is fairly natural that you would give them a job as you would presumably want them to inherit the business. Again, fairly standard business practice.

I have always called it the legal business as it is a bloody racket.

Barristers can't work together in chambers in this country. Each of them is a sole trader so there wouldn't be any cushy jobs to apply for. There are both Solicitors and Barristers in Courthouse chambers, but only the Barristers wear wigs.

You didn't answer my question in relation to the first point. What is the issue with a professional looking after a client they will earn money from?

Of course law is a business, there is nothing inherently wrong with that though.

Like cushy positions in family firms? Or other cushy positions? Your post isn't exactly clear.

I'm pretty sure the same controls applies to banks and many other industries yet fraud happens and people get away with it for a number of reasons. Your opinion that it is virtually impossible seems very naive to me. Accountants can only analyse the accounts they are given, they very rarely will find something they are not looking for or don't know exists. It is generally only when the fraud is revealed that all the relevant details come to light i.e Anglo, Irish Permanent dodgy loan. So basically Smaug is correct in his assertions, in many cases it is only the greed of the perpetrator that is their undoing, if say after a one year period without detection they decamped to foreign climes you'd probably see that it is quite easy to get away with, especially in cases where the client trusts the trustee of their funds and therefore is unlikely to constantly monitor these funds. Checks and balances are fine but they are only useful to a certain extent, in fact you could argue that because people know these checks are in place they become more trusting and thus more susceptible to fraud.

If you look at your point logically then because it is virtually impossible to get away with fraud would imply someone would need to quite stupid to even attempt it, yet we know it happens, so are you saying many in the legal profession (and others) are quite thick??

A rogue breast cancer surgeon received £216,000 in legal aid – despite building an extensive property empire in the UK and owning a holiday home in Florida.

In the aftermath of Paterson’s convictions, details emerged about his lavish property portfolio and love of expensive paintings and fine wine – funded by his NHS and private work.

In 2015, the Scottish-born surgeon bought a three-bedroom condominium in Florida – which he still co-owns.

According to Manatee County property records, Paterson owns the house with his twin daughters. It’s estimated to be worth £107,000 ($138,000).

But the US property is nothing compared with his former UK family home in Edgbaston, Birmingham. The Grade II-listed Georgian mansion was sold in July 2013 for £1.25million.

It boasts eight bedrooms, four reception rooms, a wine cellar and a coach house converted into a gym. The house was conveniently located for the £13,000-a-year King Edward’s School where his son, now a 32-year-old barrister, was privately educated and the King Edward VI High School for Girls, where his daughters, now 30, studied.

Paterson had also invested in a number of buy-to-let properties in Manchester and Cardiff, police revealed last year.
